Acceptance of TermsBy accessing or using the Web Platform located at http://patient.doctoroncall-access.com ("the Platform") to request or receive housecall medical services, you ("the Patient") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use. If you do not agree to these Terms, you must not access or use the Platform, or any services provided through it.

EligibilityTo use the Platform and request a housecall, you must be at least 18 years old and legally competent to enter into these Terms. If the individual requiring medical services is a minor or otherwise unable to make independent medical decisions, a parent, legal guardian, or duly authorized representative must facilitate and oversee the use of the service. The Platform disclaims any responsibility or liability arising from unauthorized use by minors or individuals lacking legal capacity without appropriate supervision.

Nature of Services
Medical Housecall Medical Visits: The Platform enables patients to schedule non-emergency, in-person visits from licensed healthcare providers at their home or another preferred location. These services are designed for convenience and accessibility but are strictly for non-urgent medical needs.
Non-Emergency Services Only: Housecall services provided through the Platform are not intended for emergency situations. If you or someone else is experiencing a medical emergency, you must immediately call local emergency line or go to the nearest medical facility.
If a patient chooses to request a housecall during an emergency situation—despite clear guidelines—the responsibility for that decision lies solely with the patient. While the healthcare provider may offer assistance to the best of their ability upon arrival, any legal or medical consequences arising from misuse of the service in an emergency context are the sole responsibility of the patient.
Scope of Care: Housecall services may include a range of non-emergency medical care, such as physical examinations, diagnostic assessments, development of treatment plans, prescription of medications, and follow-up care. However, if the attending healthcare provider determines that a patient’s condition requires specialized evaluation or advanced treatment, they may refer the patient to an appropriate hospital or clinic for further medical attention. If the patient chooses to disregard or refuse the healthcare provider’s recommendation for referral or further care, any resulting risks, complications, or consequences will be solely the responsibility of the patient.

Medical Case CreationRegistration: To request housecall services, users must provide accurate and up-to-date personal and medical information to your assistance company or hotel. This information is essential for ensuring safe and appropriate care. Furthermore, the use of the patient’s phone number, as obtained by the assistance company, or the hotel, will be used before, during, and after the consultation, to provide details regarding the appointment.

Patient ResponsibilitiesWhen requesting a housecall consultation, you are required to provide complete, accurate, and truthful information regarding your insurance claims, coverage details, medical condition, symptoms, medical history, and any other details relevant to your care. Inaccurate, incomplete, or misleading information may result in inappropriate or delayed treatment.
The Platform and healthcare providers cannot be held liable for any harm, complications, or delays in care resulting from the user’s failure to provide accurate and complete information. Patients are fully responsible for ensuring that all pertinent information is disclosed clearly and in a timely manner to support safe and effective medical care. Doctor On Call Access does not assume any responsibility or liability for false, misleading, or fraudulent information submitted by patients. Any such actions may constitute insurance fraud, a criminal offense, and will be reported to the appropriate authorities as required by law.
In cases where a patient is not covered by the designated assistance company, the requested medical consultation cannot be provided. Patients without valid coverage are not eligible to receive housecall services through the Platform. For further assistance or to confirm your coverage status, please contact your insurance provider or assistance company directly.
For Hotel’s Guest: To request a housecall service, please contact your hotel. If your hotel is not a partner and you would still like to request a housecall service, please contact Doctor on Call at +66818196817 (available on WhatsApp).
Safe Environment for housecall: Patients are responsible for ensuring that the location designated for the housecall consultation is safe and suitable for the delivery of medical services. If the healthcare provider determines that the environment is unsafe or inappropriate for medical care, they have the right to refuse or immediately terminate the service. In such cases, the patient may be held responsible for any applicable cancellation or no-show fees as determined by their insurance provider or assistance company. For hotel guests, our platform will charge 60-100% of the full-service fee as a cancellation fee. This cancellation fee is made at our sole discretion and considered final.
Follow-Up Care: Patients are responsible for adhering to any medical advice, treatment plans, or referrals provided by the healthcare provider during the housecall visit. If additional medical attention or follow-up care is recommended, it is the patient’s responsibility to seek such care promptly and appropriately. Failure to do so may result in complications for which the healthcare provider and the Platform are not liable. Arrangements outside of the Platform: Patients must not make independent arrangements with healthcare providers or partner pharmacies outside of our platform. This includes, but is not limited to, scheduling follow-up appointments or offering/processing payments directly. We are not responsible for any services, outcomes, or issues arising from interactions or transactions that occur outside our system Legal Compliance: By using the Platform and its services, you agree to comply with all applicable local laws and regulations. Any misuse of the services, including but not limited to fraud, misrepresentation, or violation of terms, may result in the termination of access to the platform, blacklisting, and potential legal action by the Doctor On Call Access platform.

Privacy and Data ProtectionPersonal Data: Your personal and medical information will be collected and stored in accordance with the Platform’s [Privacy Policy]. We adhere to relevant data protection laws, including Personal Data Protection Act B.E. 2562 (PDPA) of Thailand. By using the Platform, you consent to the collection, processing, and sharing of your information with the assistance company and your insurance provider for the purpose of facilitating housecall services and ensuring appropriate care. Despite our best efforts, no method of transmission over the internet or electronic storage is completely secure. By using our Platform, you acknowledge and accept these limitations and agree to notify us immediately if you believe your data has been compromised. Confidentiality: The information you share with the healthcare provider during a housecall consultation is confidential and protected. Your medical data may be shared with the assistance company and your insurance provider as necessary to coordinate your care and process claims. Except as required by law or with your explicit consent, your information will not be disclosed to third parties. For Hotel’s Guest: By requesting the service, you also authorize the hotel to release your necessary medical information to the platform in order to coordinate and arrange the housecall visit. Consent: By clicking "Accept," you consent to the collection, use, and disclosure of your sensitive personal data, including health and payment information, for the purposes of providing housecall healthcare services. You acknowledge that your data may be shared with insurance companies, assistance companies, and partner hotels as necessary, and that you have the right to access, correct, withdraw, or delete your data at any time.

Fees, Payments, and Refunds
Service Fees: For the uninsured traveler, the fees for housecall services are clearly outlined on the Platform and may vary depending on factors such as the type of service and location. By booking a housecall, you agree to pay the specified fees in full prior to the service being rendered. If additional services are required, such as IV treatment or lab tests, extra charges may apply. Payment Methods: Accepted payment methods are listed on the Platform. By submitting your payment information, you authorize the Platform to charge the applicable fees for services rendered in accordance with the booking details. Medication: Medication prescribed by the physician through the Platform shall be eligible for delivery to you by an authorized pharmacy and delivery service. The medication delivery is subject to the terms of the individual’s insurance policy, including eligibility, formulary compliance, and cost-sharing obligations such as deductibles or copayments. For the self-paying patient, all costs related to the medication and its delivery are included in the payment made through the housecall service of the Platform that you request with your hotel. By accepting delivery, you confirm that you have received the prescriptions as a result of a valid consultation. The healthcare provider and delivery service shall not be held liable for delays, loss, or improper storage once the medication has been dispatched, provided reasonable delivery standards were met. Refund Policy: Refunds are only issued in specific circumstances, such as cancellations by the healthcare provider or failure to complete the visit due to unforeseen circumstances. To request a refund, you must submit your request within 24 hours of the scheduled housecall. All refund decisions, including the determination of any refund amount, are made at our sole discretion and are final.

Medical DisclaimersNo Guarantee of Specific Outcomes: The Platform facilitates housecall consultations with licensed healthcare professionals; however, it does not guarantee specific medical results or outcomes. All medical advice and treatment provided during a housecall are based on the patient’s condition, the information available at the time of the visit, and the limitations of care that can be delivered in a home setting. Appropriate Care Settings: Certain medical conditions may require more advanced, specialized, or urgent care that cannot be adequately provided through a housecall. In such cases, the healthcare provider may refer you to a hospital, clinic, or specialist to ensure you receive the most appropriate and effective treatment. You have the right to refuse a referral; however, any consequences resulting from that decision will be solely your responsibility. The Platform and healthcare provider are not liable for any complications or delays in care arising from a refusal to seek the recommended follow-up or specialized treatment.

Limitation of LiabilityHealthcare Provider Responsibility: Healthcare providers on the Doctor Access platform are independent practitioners and are not employees or direct hires of Doctor Access. These providers choose to offer their services through the platform at their own discretion. Doctor Access acts solely as a facilitator and is not responsible for the professional conduct, medical decisions, or practices of the healthcare providers. Each healthcare provider is solely responsible for their own medical practice and patient care. The Platform does not interfere with, influence, or direct the healthcare providers in the treatment or care of patients. Doctor Access shall not be liable for any damages, claims, or injuries arising from the professional acts, omissions, or advice of healthcare providers accessed through the platform. Service Availability: While the Platform makes every effort to ensure the timely and reliable delivery of housecall services, it is not responsible for delays, cancellations, or disruptions caused by circumstances beyond its control, including but not limited to traffic conditions, severe weather, or unforeseen emergencies.Indemnification: By using the service, you agree to indemnify, defend, and hold harmless the Platform, its affiliates, and partners from any claims, liabilities, damages, or expenses arising from your use of the service. This includes, but is not limited to, any injuries, complications, or legal disputes resulting from the actions or omissions of the healthcare provider during the housecall.

Third-Party ServiceThe Platform may include links to or integrations with third-party services, such as pharmacies, diagnostic laboratories, or other healthcare-related providers. These third parties operate independently, and the Platform is not responsible for the accuracy, content, availability, products, or services they offer. Any interactions, transactions, or engagements with these third parties are entirely at your own risk and responsibility. We strongly advise you to review the terms and conditions of any third-party services before engaging with them.

Termination of UseVoluntary Termination: You may choose to terminate your medical request at any time by, however charges may apply depending on time of termination. For immediate consultation cases, if a cancellation is made more than five minutes after the request is submitted, the patient—or their insurance provider—will be responsible for 40% of the medical request fee. For scheduled appointment cases, if the cancellation is made less than 30 minutes before the scheduled time, a fee amounting to 50% of the medical request fee will be charged. Please note that termination does not absolve you of any outstanding obligations, including unpaid fees, cancellation fees, scheduled appointments, or pending service-related matters.Physician-Initiated Termination: The physician also reserves the right to terminate the medical request. This may occur if the patient fails to attend the appointment and does not respond to communications, or if the physician deems it unsafe, unethical, or otherwise inappropriate to proceed with or continue the consultation. In such cases, a portion or full amount of the medical request fee may still be charged depending on the situation and resources committed prior to termination. Additionally, requests may be terminated if the patient provides inaccurate, incomplete, or misleading information that affects the integrity or safety of the consultation process. Platform-Initiated Termination: The Platform reserves the right to suspend or permanently terminate your access to the platform at its sole discretion, especially in cases of violations of these Terms, fraudulent behavior, misuse of the services, or conduct deemed harmful to other users or healthcare providers.
In the event of unforeseen circumstances such as technical failures, natural disasters or regulatory restrictions—classified as force majeure—neither the patient nor the physician shall be held reliable for cancellations. In such situations, both parties agree to seek a fair and practical resolution without penalty.

Modifications to TermsThe Platform reserves the right to modify these Terms of Use at any time. Any significant changes will be communicated through email notifications or alerts within the Platform. By continuing to use the Platform and its services after such modifications have been made, you acknowledge and agree to be bound by the updated Terms. It is your responsibility to review the Terms periodically to stay informed of any changes.

Governing Law and Dispute ResolutionThese Terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising out of or in connection with these Terms or the services provided through the Platform shall first be subject to mediation in good faith. If the dispute cannot be resolved through mediation, it shall be submitted to the exclusive jurisdiction of the courts of Thailand.

Acceptance of TermsBy accessing or using the Web Platform located at http://patient.doctoroncall-access.com ("the Platform") to request or receive housecall medical services, you ("the Patient") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use. If you do not agree to these Terms, you must not access or use the Platform, or any services provided through it.

EligibilityTo use the Platform and request a housecall, you must be at least 18 years old and legally competent to enter into these Terms. If the individual requiring medical services is a minor or otherwise unable to make independent medical decisions, a parent, legal guardian, or duly authorized representative must facilitate and oversee the use of the service. The Platform disclaims any responsibility or liability arising from unauthorized use by minors or individuals lacking legal capacity without appropriate supervision.

Nature of Services
Medical Housecall Medical Visits: The Platform enables patients to schedule non-emergency, in-person visits from licensed healthcare providers at their home or another preferred location. These services are designed for convenience and accessibility but are strictly for non-urgent medical needs.
Non-Emergency Services Only: Housecall services provided through the Platform are not intended for emergency situations. If you or someone else is experiencing a medical emergency, you must immediately call local emergency line or go to the nearest medical facility.
If a patient chooses to request a housecall during an emergency situation—despite clear guidelines—the responsibility for that decision lies solely with the patient. While the healthcare provider may offer assistance to the best of their ability upon arrival, any legal or medical consequences arising from misuse of the service in an emergency context are the sole responsibility of the patient.
Scope of Care: Housecall services may include a range of non-emergency medical care, such as physical examinations, diagnostic assessments, development of treatment plans, prescription of medications, and follow-up care. However, if the attending healthcare provider determines that a patient’s condition requires specialized evaluation or advanced treatment, they may refer the patient to an appropriate hospital or clinic for further medical attention. If the patient chooses to disregard or refuse the healthcare provider’s recommendation for referral or further care, any resulting risks, complications, or consequences will be solely the responsibility of the patient.

Medical Case CreationRegistration: To request housecall services, users must provide accurate and up-to-date personal and medical information to your assistance company or hotel. This information is essential for ensuring safe and appropriate care. Furthermore, the use of the patient’s phone number, as obtained by the assistance company, or the hotel, will be used before, during, and after the consultation, to provide details regarding the appointment.

Patient ResponsibilitiesWhen requesting a housecall consultation, you are required to provide complete, accurate, and truthful information regarding your insurance claims, coverage details, medical condition, symptoms, medical history, and any other details relevant to your care. Inaccurate, incomplete, or misleading information may result in inappropriate or delayed treatment.
The Platform and healthcare providers cannot be held liable for any harm, complications, or delays in care resulting from the user’s failure to provide accurate and complete information. Patients are fully responsible for ensuring that all pertinent information is disclosed clearly and in a timely manner to support safe and effective medical care. Doctor On Call Access does not assume any responsibility or liability for false, misleading, or fraudulent information submitted by patients. Any such actions may constitute insurance fraud, a criminal offense, and will be reported to the appropriate authorities as required by law.
In cases where a patient is not covered by the designated assistance company, the requested medical consultation cannot be provided. Patients without valid coverage are not eligible to receive housecall services through the Platform. For further assistance or to confirm your coverage status, please contact your insurance provider or assistance company directly.
For Hotel’s Guest: To request a housecall service, please contact your hotel. If your hotel is not a partner and you would still like to request a housecall service, please contact Doctor on Call at +66818196817 (available on WhatsApp).
Safe Environment for housecall: Patients are responsible for ensuring that the location designated for the housecall consultation is safe and suitable for the delivery of medical services. If the healthcare provider determines that the environment is unsafe or inappropriate for medical care, they have the right to refuse or immediately terminate the service. In such cases, the patient may be held responsible for any applicable cancellation or no-show fees as determined by their insurance provider or assistance company. For hotel guests, our platform will charge 60-100% of the full-service fee as a cancellation fee. This cancellation fee is made at our sole discretion and considered final.
Follow-Up Care: Patients are responsible for adhering to any medical advice, treatment plans, or referrals provided by the healthcare provider during the housecall visit. If additional medical attention or follow-up care is recommended, it is the patient’s responsibility to seek such care promptly and appropriately. Failure to do so may result in complications for which the healthcare provider and the Platform are not liable. Arrangements outside of the Platform: Patients must not make independent arrangements with healthcare providers or partner pharmacies outside of our platform. This includes, but is not limited to, scheduling follow-up appointments or offering/processing payments directly. We are not responsible for any services, outcomes, or issues arising from interactions or transactions that occur outside our system Legal Compliance: By using the Platform and its services, you agree to comply with all applicable local laws and regulations. Any misuse of the services, including but not limited to fraud, misrepresentation, or violation of terms, may result in the termination of access to the platform, blacklisting, and potential legal action by the Doctor On Call Access platform.

Privacy and Data ProtectionPersonal Data: Your personal and medical information will be collected and stored in accordance with the Platform’s [Privacy Policy]. We adhere to relevant data protection laws, including Personal Data Protection Act B.E. 2562 (PDPA) of Thailand. By using the Platform, you consent to the collection, processing, and sharing of your information with the assistance company and your insurance provider for the purpose of facilitating housecall services and ensuring appropriate care. Despite our best efforts, no method of transmission over the internet or electronic storage is completely secure. By using our Platform, you acknowledge and accept these limitations and agree to notify us immediately if you believe your data has been compromised. Confidentiality: The information you share with the healthcare provider during a housecall consultation is confidential and protected. Your medical data may be shared with the assistance company and your insurance provider as necessary to coordinate your care and process claims. Except as required by law or with your explicit consent, your information will not be disclosed to third parties. For Hotel’s Guest: By requesting the service, you also authorize the hotel to release your necessary medical information to the platform in order to coordinate and arrange the housecall visit. Consent: By clicking "Accept," you consent to the collection, use, and disclosure of your sensitive personal data, including health and payment information, for the purposes of providing housecall healthcare services. You acknowledge that your data may be shared with insurance companies, assistance companies, and partner hotels as necessary, and that you have the right to access, correct, withdraw, or delete your data at any time.

Fees, Payments, and Refunds
Service Fees: For the uninsured traveler, the fees for housecall services are clearly outlined on the Platform and may vary depending on factors such as the type of service and location. By booking a housecall, you agree to pay the specified fees in full prior to the service being rendered. If additional services are required, such as IV treatment or lab tests, extra charges may apply. Payment Methods: Accepted payment methods are listed on the Platform. By submitting your payment information, you authorize the Platform to charge the applicable fees for services rendered in accordance with the booking details. Medication: Medication prescribed by the physician through the Platform shall be eligible for delivery to you by an authorized pharmacy and delivery service. The medication delivery is subject to the terms of the individual’s insurance policy, including eligibility, formulary compliance, and cost-sharing obligations such as deductibles or copayments. For the self-paying patient, all costs related to the medication and its delivery are included in the payment made through the housecall service of the Platform that you request with your hotel. By accepting delivery, you confirm that you have received the prescriptions as a result of a valid consultation. The healthcare provider and delivery service shall not be held liable for delays, loss, or improper storage once the medication has been dispatched, provided reasonable delivery standards were met. Refund Policy: Refunds are only issued in specific circumstances, such as cancellations by the healthcare provider or failure to complete the visit due to unforeseen circumstances. To request a refund, you must submit your request within 24 hours of the scheduled housecall. All refund decisions, including the determination of any refund amount, are made at our sole discretion and are final.

Medical DisclaimersNo Guarantee of Specific Outcomes: The Platform facilitates housecall consultations with licensed healthcare professionals; however, it does not guarantee specific medical results or outcomes. All medical advice and treatment provided during a housecall are based on the patient’s condition, the information available at the time of the visit, and the limitations of care that can be delivered in a home setting. Appropriate Care Settings: Certain medical conditions may require more advanced, specialized, or urgent care that cannot be adequately provided through a housecall. In such cases, the healthcare provider may refer you to a hospital, clinic, or specialist to ensure you receive the most appropriate and effective treatment. You have the right to refuse a referral; however, any consequences resulting from that decision will be solely your responsibility. The Platform and healthcare provider are not liable for any complications or delays in care arising from a refusal to seek the recommended follow-up or specialized treatment.

Limitation of LiabilityHealthcare Provider Responsibility: Healthcare providers on the Doctor Access platform are independent practitioners and are not employees or direct hires of Doctor Access. These providers choose to offer their services through the platform at their own discretion. Doctor Access acts solely as a facilitator and is not responsible for the professional conduct, medical decisions, or practices of the healthcare providers. Each healthcare provider is solely responsible for their own medical practice and patient care. The Platform does not interfere with, influence, or direct the healthcare providers in the treatment or care of patients. Doctor Access shall not be liable for any damages, claims, or injuries arising from the professional acts, omissions, or advice of healthcare providers accessed through the platform. Service Availability: While the Platform makes every effort to ensure the timely and reliable delivery of housecall services, it is not responsible for delays, cancellations, or disruptions caused by circumstances beyond its control, including but not limited to traffic conditions, severe weather, or unforeseen emergencies.Indemnification: By using the service, you agree to indemnify, defend, and hold harmless the Platform, its affiliates, and partners from any claims, liabilities, damages, or expenses arising from your use of the service. This includes, but is not limited to, any injuries, complications, or legal disputes resulting from the actions or omissions of the healthcare provider during the housecall.

Third-Party ServiceThe Platform may include links to or integrations with third-party services, such as pharmacies, diagnostic laboratories, or other healthcare-related providers. These third parties operate independently, and the Platform is not responsible for the accuracy, content, availability, products, or services they offer. Any interactions, transactions, or engagements with these third parties are entirely at your own risk and responsibility. We strongly advise you to review the terms and conditions of any third-party services before engaging with them.

Termination of UseVoluntary Termination: You may choose to terminate your medical request at any time by, however charges may apply depending on time of termination. For immediate consultation cases, if a cancellation is made more than five minutes after the request is submitted, the patient—or their insurance provider—will be responsible for 40% of the medical request fee. For scheduled appointment cases, if the cancellation is made less than 30 minutes before the scheduled time, a fee amounting to 50% of the medical request fee will be charged. Please note that termination does not absolve you of any outstanding obligations, including unpaid fees, cancellation fees, scheduled appointments, or pending service-related matters.Physician-Initiated Termination: The physician also reserves the right to terminate the medical request. This may occur if the patient fails to attend the appointment and does not respond to communications, or if the physician deems it unsafe, unethical, or otherwise inappropriate to proceed with or continue the consultation. In such cases, a portion or full amount of the medical request fee may still be charged depending on the situation and resources committed prior to termination. Additionally, requests may be terminated if the patient provides inaccurate, incomplete, or misleading information that affects the integrity or safety of the consultation process. Platform-Initiated Termination: The Platform reserves the right to suspend or permanently terminate your access to the platform at its sole discretion, especially in cases of violations of these Terms, fraudulent behavior, misuse of the services, or conduct deemed harmful to other users or healthcare providers.
In the event of unforeseen circumstances such as technical failures, natural disasters or regulatory restrictions—classified as force majeure—neither the patient nor the physician shall be held reliable for cancellations. In such situations, both parties agree to seek a fair and practical resolution without penalty.

Modifications to TermsThe Platform reserves the right to modify these Terms of Use at any time. Any significant changes will be communicated through email notifications or alerts within the Platform. By continuing to use the Platform and its services after such modifications have been made, you acknowledge and agree to be bound by the updated Terms. It is your responsibility to review the Terms periodically to stay informed of any changes.

Governing Law and Dispute ResolutionThese Terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising out of or in connection with these Terms or the services provided through the Platform shall first be subject to mediation in good faith. If the dispute cannot be resolved through mediation, it shall be submitted to the exclusive jurisdiction of the courts of Thailand.
